Terms of Use

1. Purpose and acceptance

These Terms of Use define the rules for accessing and using the FuturMoi service (futurmoi.fr), published by NDA Conseil (SASU).

Using the service implies full and unreserved acceptance of these Terms. If you do not accept these terms, you must refrain from using the service.

The FuturMoi service is reserved for persons aged 15 and over. In accordance with the digital majority age defined by applicable law, persons under 15 are not authorised to use this service. By using FuturMoi, you declare that you are 15 or older.

2. Service description

FuturMoi is a digital time capsule service that allows any user to:

• Write a message (text) to be received on a future date of their choosing
• Enrich this message with attachments (photo, audio file, video)
• Share their capsule publicly or via a private link

The service is available without prior registration. No permanent account is created.

3. How does FuturMoi work?

Step 1: Write your message
Go to the writing page and fill in the form: your first name or nickname, your email address, your text, and the desired reception date (up to 10 years in the future). You can also allow anonymous display of an excerpt to inspire other visitors.

Step 2: Choose your attachments
You can add a photo, video, or audio file to your capsule. Audio files are limited to 5 recordings per capsule with a total duration of 5 minutes, and videos to 5 videos per capsule with a total duration of 5 minutes. Attachments are billed — see Pricing.

Step 3: Your capsule is placed on hold
Your text is stored securely, but not yet confirmed. It awaits your email address confirmation.

Step 4: Confirm by email
Open your inbox: you have received a 6-digit code. Enter it on the validation page to permanently seal your capsule. This step is essential: it verifies that your email address is valid. Without confirmation within the allotted time, the message is deleted.

Step 5: Wait… and discover
The capsule travels silently until the chosen date. That morning, your past self writes to you.

4. Service access and technical limitations

4.1 Free daily limit

Each email address can create 5 free text capsules per day (calendar period from 00:00 to 23:59). Beyond this, payment is required (see Pricing).

4.2 Maximum duration

The reception date can be set from 1 day to 10 years in the future.

4.3 Email address change

You can change the recipient email address of a capsule via the Change email address page, subject to validation of both addresses.

4.4 Downloading attachments after delivery

On the capsule delivery date, the recipient receives an email containing a secure link to download the attachments (photo, audio, video). This link remains active for 15 days from the capsule send date.

Several reminder emails are sent during this period, including a final reminder the day before expiry.

After this 15-day period:

• The download link expires and attachments are archived on separate servers;
• File recovery remains possible on request for one year from the capsule send date, subject to a flat recovery fee of €15.00 incl. VAT;
• After this full year, attachments are permanently deleted with no possibility of recovery.

5. User obligations

5.0 Minimum age

Access to the service is reserved for persons aged 15 and over. Use of the service by anyone under 15 is strictly prohibited. If FuturMoi becomes aware that a user is under 15, the associated data will be deleted immediately.

5.1 Fair use

The user undertakes to use FuturMoi in good faith, in compliance with applicable laws and regulations, and without infringing the rights of third parties or the integrity of the service.

Strictly prohibited:

• Use of robots, scripts, or automated tools to create capsules in bulk
• Any attempt to gain unauthorised access to servers or third-party data
• Use of the service for commercial purposes without prior authorisation

5.2 Capsule content

The user is solely responsible for the content they write in their capsule. They undertake to ensure that the content:

• Does not contain hateful, discriminatory, or violence-inciting content
• Does not include attacks targeting any person or group based on origin, religion, gender, sexual orientation, disability, or any other protected characteristic
• Is not illegal, defamatory, harassing, or infringing on others' privacy
• Does not contain pornographic or sexually explicit content
• Does not infringe any third-party intellectual property rights

5.3 Public capsules

By choosing to make a capsule public, the user accepts that its content will be visible to the entire FuturMoi community and potentially shared by other users. FuturMoi reserves the right to remove without notice any public capsule that does not comply with these commitments.

FuturMoi is a kind space. If you read a problematic public capsule, use the Report button available on each capsule.

5.4 Content ownership

The user retains all intellectual property rights over the content they create in their capsule. By making a capsule public, they grant FuturMoi a non-exclusive, royalty-free, worldwide licence to display and distribute it on the platform, for the sole purposes of the service.

6. Service guarantees and limitations

• Best-efforts obligation: FuturMoi does everything possible to deliver capsules on the chosen date, but does not guarantee an absolute result.
• Spam filtering: FuturMoi cannot be held responsible for filtering by the recipient's email service.
• Technical incident: In the event of a technical problem, if the date has passed, the message will not be deleted and will be sent with the next dispatch batch as soon as possible.
• Inaccessible email address: If your email address is deleted or inaccessible between confirmation and the reception date, the message will enter a database called "lost capsules".
• Service closure: In the event of closure, FuturMoi undertakes to notify users at least 3 months in advance and to attempt to immediately send all pending capsules. See the GTS for refund details.

7. Personal data and privacy

• No tracking or analytics cookies. Only a temporary session identifier deleted when the browser is closed.
• Your personal data will never be sold or transferred to third parties for commercial purposes.
• Once the capsule is delivered, the message and all associated data are permanently deleted within 30 days. Exception: for paid capsules, the email address linked to the transaction is retained for 10 years in accounting records (legal obligation).

8. FuturMoi's liability

FuturMoi cannot be held liable for:

• The content of messages written by users
• Indirect damages resulting from use or inability to use the service
• Service interruptions due to force majeure events

FuturMoi's liability is limited, where applicable, to the amount paid by the user for the service concerned.

9. Modification of Terms

FuturMoi reserves the right to modify these Terms at any time. Modifications take effect upon publication on this page. In the event of a material modification, users with an active capsule will be notified by email where possible. The effective date is indicated at the top of this page.

Continued use of the service after modification constitutes acceptance of the new Terms.

10. Applicable law and mediation

These Terms are governed by French law. In the event of a dispute, the user may contact customer service at contact[at]futurmoi.fr. If the dispute is not resolved, consumer mediation is available — see the GTS, article 12 for mediator contact details.

11. Collective capsules (FuturNous)

FuturNous is a feature of the service allowing several users to write a single time capsule together. The creator opens the capsule, sets the delivery date and the filling period, and invites co-participants to join the capsule via a shared code. On the delivery date, all finalised co-participants receive the full set of contributions in a single grouped e-mail.

11.1 Paid service

Collective capsules are always paid, regardless of the daily free allowance applicable to individual capsules. Pricing details are set out on the Pricing page and in the GTS, article 13.

11.2 Kindness between co-participants

Content written by each co-participant is visible to all other finalised co-participants on the delivery date. By participating, you undertake to maintain a kind attitude towards the other contributors and not to publish content contrary to the obligations set out in article 5 of these Terms. Inappropriate contributions may lead to the full purge of the collective capsule without refund.

11.3 Filling period and automatic closing

The filling period chosen by the creator (from 30 minutes to 7 days) starts at the creation of the capsule. At its end, the capsule is processed automatically depending on the number of finalised contributions: grouped delivery (≥ 2 contributions), downgrade to an individual capsule (1 contribution) or purge (0 contribution). 11.4 No cancellation after generation of the collective code

Once the collective code has been generated and sent to the creator, the service is deemed performed; no cancellation is possible. An automatic refund is issued to the creator in the event of an "empty" capsule or of offered access slots remaining unused (see GTS, article 13.5).
